Settlement agreement and urgent reason

The settlement agreement is almost always an outcome of the negotiations between (the jurists of) employer and employee. A settlement agreement is therefore always custom-made and should be geared to the individual circumstances of the case. A clause that however standardly returns in every settlement agreement, or at least, should return is the clause in which it is described that the reason for the dismissal is not in an urgent reason as meant in the law. That is to say that it is established that the employee is not culpably unemployed. An example for such a description is the following clause:

Urgent reason:

As a result of the irreconcilable difference of opinion and the absence of a suitable alternative position, the employer takes the initiative to terminate the employment contract with employee, of which termination no blame can be made to employee. In that context, the employer attaches importance to noting that no urgent reason as meant in art. 7:678 BW underlies the termination.

The importance of mentioning the absence of an urgent reason is great. Namely, upon application for a benefit, the UWV tests whether any blame can be attributed to the employee for his/her dismissal. If this is the case, then that will lead to a negative decision from the UWV, in the sense that the benefit (temporarily or permanently) is refused. As an employee, you then of course have a big problem. It is therefore of great importance that the settlement agreement includes that there is no urgent reason underlying the dismissal.
