In the case of an undisputed monetary claim, we perform our extrajudicial debt collection services on a 'no cure, no pay' basis. This means that our approach usually costs you nothing. If no payment is received (for example, due to a bankruptcy), our efforts will not cost you anything either. No Cure, No Pay Debt Collection
'No cure, no pay' sounds appealing, but how does it work exactly? In short, it means you pay us absolutely nothing(!) if you don’t recover your money. If you do receive your money, the debtor often covers our costs (90% of the time). The outcome of a collection case can therefore fall into one of the following four scenarios:
1. No Payment from the Debtor
If your customer pays nothing, you pay us nothing.
2. Full Payment by the Debtor
If the full claim (principal amount plus collection costs) is paid, the collection process is cost-free for you. In this case, the debtor covers the collection costs.
3. Partial Payment by the Debtor
From the (partial) payment, the collection costs (our fee) are deducted. Our costs will never exceed the amount received from your debtor.
In exceptional cases, it may happen that only a portion of the total claim, including collection costs, is paid. In such cases, our efforts have still had an effect (cure). According to the law (Article 6:44 of the Dutch Civil Code), payments are allocated to the various parts of the claim in the following order: (1) collection costs and disbursements (third-party costs), (2) interest, and (3) principal amount. We follow this order as well, with the understanding that the claim (naturally) can never exceed what the debtor has paid.
Please note that this 'no cure, no pay' approach only applies to undisputed monetary claims. If the claim is disputed by the other party, the case will be taken on (or continued) based on our standard hourly rate.
